1. General Instructions:

1.1) This User Agreement (hereinafter: “The Agreement”) refers to the online website of the online store – Jerusalem–land.com, (Hereinafter: the “Online Store” and/or “Jerusalem-land.com”) on the jerusalem-land.com website, and all the relevant websites linked to www.jerusalem-land.com.

1.2) The website www.jerusalem-land.com where the online store is located (hereinafter: the “Website”) is owned by Jerusalem-land.com.

1.3) This Agreement regulates the relationship between the management board of the Jerusalem-land.com Online Store (hereinafter: “Website Management”) and the user of this website/the customer who purchases products and/or services in the online store through the website (hereinafter: “The User” and/or “The Customer”).

1.4) The management of the website reserves the right to change, add and/or remove clauses in this agreement at any time without notifying the user.

1.5) Continued use of the website by the user means consent to the agreement and to changes made in this agreement. In case the user does not agree with these terms of use of the website, the user must cease to browse the website.

1.6) Continued use of the website after the publication of the changes in this agreement, including the terms of use of the website, will be considered as the user’s consent to these changes. The user is personally responsible for reviewing this agreement regarding the changes to it.

1.8) Continued use of the website constitutes the user’s waiver of raising claims against the website, the website management, and the operator of the website in whose name the domain is registered in person. For the avoidance of doubt, it will be clarified that the website operator may be an advertising company and not the developer of the project on the website/online store.

2. Term and Definitions

2.1) The following terms have the following meanings for purposes of this agreement:
2.1) Jerusalem-land.com – a online store website located in the domain www.jerusalem-land.com that operates on the internet, including through ancillary services.

2.1.2) The online store is a website that contains information about the products, services and the seller, and it allows to commit choosing of product/s and/or service/s, commit ordering of product/s and/or service/s and to commit purchasing of product/s and/or service/s.

2.1.3) Site Management – Employees authorized of managing the Site, operating on behalf of Jerusalem-land.com.

2.1.4) A user of the website of the online store/the customer (hereinafter: “The User and/or “The Customer) is a person who has access to the website via the internet and who uses the website.

2.1.5) The content of the online store’s website (hereinafter: The “Content”) is the protected results of intellectual activity, including texts of literary works, their titles, introductions, articles, articles, images, musical works with or without text, graphic and/or textual works, photographs, other complex works, user interfaces, visual interfaces, trademark names, logos, computer software, databases, as well as the design, structure, selection, coordination, appearance, general style and arrangement of this content contained in the website and other intellectual property objects, all together and/or each of them individually included on the online store’s website.

3. The Essence of the Agreement

3.1) The essence of the agreement is to provide the online store user access to the products and the services offered on the website.

3.1.1) The online store provides the user the following types of services:

• Access to online store search and navigation tools;
• Access to information about the purchase of the paid products and services, as well as information about the product and services;
• Different types of services sold on the online store pages.

3.1.2) This agreement applies to all (actual operating) existing services of the online store, as well as all post-change services and additional services of the online store that will appear in the future.

3.2) Access to the online store is provided free of charge.

3.3) This agreement is a public offer. Upon entering the website, the user is considered to have joined this agreement.

3.4) The user is aware that the images of the products and/or services on the website may be somewhat different from the products and/or services that the user will receive in the mail/depending on one service or another. The photos in the online store are for illustration purposes only.

3.5) The use of material and/or services of the website is subject to the current legislative norms in Israel.

4. The Rights and Obligations of the Parties to this Agreement

4.1) The websites management has the right to:

4.1.1) Change the terms of use of the website, as well as this websites content. The changes come into effect from the moment the latest version of the agreement is published on the website.

4.1.2) Restrict access to the website in the event of a breach of the term of this agreement by the user.

4.1.3) Update products and/or services costs on the website at all times and from time to time. These changes will not apply retroactively, i.e., no change will apply to a product and/or service whose order was placed before the new price was updated.

• Regarding the piece of land rental services offered in the online store (hereinafter: “pieces of land” and/or “piece of land”), the user is aware about the following:
• The piece of land is 10*10cm in size; All pieced of land have the same area, i.e., each of them is 10*10cm in size.

• The service provided is for rent only for a period of one year (minimum) to 5 years (maximum). For the avoidance of doubt, it will be clarified that, there is not and will not be any possibility of ownership and/or an option for ownership and/or the right to transfer and/or purchase of pieces of land of any kind and in any way. It will be clarified that in the event that it is possible to extend the rental period of the piece of land for an additional rental period, this information will be published on the website and/or messages will be sent in accordance with the email addresses provided by the users.

• The pieces of land are located in the territory of the State of Israel. It will be clarified that the geographical location of the piece of land may change from time to time, including during the period in which Jerusalem-land.com provides the piece of land  rental services to the user and that is without informing the user about the transfer of the geographical location of the piece of lands rented by the user from Jerusalem-land.com – any change in the location will be made by the sole discretion of Jerusalem-land.com and will be within the territory of the State of Israel, without changing the size of the original piece of land.

• The user is allowed to rent all pieces of land that the online store offers for rent, and which are available for rent at the time the order is placed by the user. For the avoidance of doubt, it will be clarified that the number of pieces of land in the online store changes from time to time. It will also be noted that the number of pieces of land in the online store is limited, therefore the user will not be able to rent a number of pieces of land that exceeds the number of pieces of land available on the website at the time of ordering by the user.

• The pieces of land are rented for a period of: minimum for one year and up to 5 years maximum. It will be clarified that after placing an order and payment it is not possible to change the duration of the rental period.

• The pieces of land are agricultural soil. The user is aware that the following actions are prohibited to perform: perform burial, including full or partial burial of animals, plant trees and vegetation, build, including light construction and/or any other use, which does not match the essence of the service.
• The user undertakes not to sub rent the piece of land he rented from Jerusalem-land.com to a third party.
• For users who have rented pieces of land, a complementary service is offered for an additional fee that allows the user to send to Jerusalem-land.com a tiny object that can be buried in the ground in a single piece of land area rented by the user. The same object must match the size of the piece of land, i.e., the maximum size of the above-mentioned object will be 5X5X5 cm. It will be clarified that in the case where the user rents a number of pieces of land, it will not be possible to receive an object for the purpose of burying it as described above in a size exceeding 5X5X5cm, i.e., one piece of land. The object shall not exceed 100g in weight (hereinafter: “The Object”). Moreover, the user undertakes that the object he sends will be a legal item in accordance with the laws of the State of Israel (for the avoidance of doubt it will be clarified that hazardous substances, such as drugs, radioactive and/or chemical substances, etc., drugs, firearms and ammunition, weapons Cold, pollutants, live or dead creature, plants, etc.).

It should be emphasized that Jerusalem-land.com is not responsible for the object’s condition.

• An option to send an object to Jerusalem-land.com for burial purposes in the piece of land rented by the user from Jerusalem-land.com, will be open only after placing an order, including the full payment for renting the pieces of land.
• It should be noted that shipping fees constitute an additional cost and will be paid by the user only. The selection of the shipping company will be made by Jerusalem-land.com solely out of its considerations.
• Near the end of the renal period of the piece of land by the user, he will be notified by email that he has given a notice accordingly, in order to allow the user to continue renting the services of Jerusalem-land.com.
• The cost of piece of land rental services may vary from time to time.
• The communication between Jerusalem-land.com and the user will be made by email only.

• Regarding the purchase of the products in the online store (hereinafter: “The Products”), the user is aware that:
• The prices of the products in the online store may change from time to time, however they will not apply retroactively, i.e., in a case of change in the price of one product or another, the change of price will not apply to the same product after its purchase and actual payment by the user. The price that appears on the website is the valid price for ordering and purchasing.
• The purchase cannot be canceled after the purchased product has been sent.
• The shipping fee is an additional cost and will be paid by the user only. The selection of the shipping company will be made by Jerusalem-land.com solely out of its considerations.
• You can purchase all the products that are available for purchase in the online store.

4.1.6) The user is aware that the images of the products/pieces of land on the website may be slightly different from the product/piece of land that the user will receive in the mail/actual/depending on the service. The photos are for illustration only. Product images/pieces of land, including color, may differ from the actual appearance. Jerusalem-land.com may change components without prior notice. Please note that all details of the above products/services and delivery times are for information purposes only and do not constitute a public offer. 4.1.7) Jerusalem-land.com may from time to time make money transfers to one association or another, both within the territory of the State of Israel and abroad, out of its exclusive and unlimited considerations, including regarding the amount of transfer, number of transfers and frequency of transfers.

4.1.8) Prices of products and/or services in the online store and execution of payment:

• All prices include VAT. For the avoidance of doubt, it will be clarified that in case the user is abroad, then he will receive an invoice (INVOICE) without VAT and the price to be paid will be in USA dollars.
• The price that appears on the website is the valid price for the purchase. It is clarified that Jerusalem-land.com reserves itself the right to change the prices of the products and/or services on the website at any time without prior notice. For the avoidance of doubt, it will be clarified that the price changes will not apply retroactively, i.e., in case the price of some or other product and/or service changes, the price change will not apply to the same product and/or service after its purchase and actual execution of the payment.
• The user will provide through the website the details of his personal credit card that is in his possession and on his name and which can be charged and removed in Israel. The credit card details will include: card number, the full name of the cardholder, security number, card validity, ID/ID number (if the user is abroad), phone number and exact shipping address.
• In case the credit company does not approve the transaction, the user will be notified on the matter.
• The invoice will be sent to the user via email to the email address he provided;
• Giving false information constitutes a criminal offense and the committer is subject to the penalties provided by law and criminal legal proceedings.

4.1.9) Online Purchasing

• The sale takes effect only after the entire order process has been carried out by the user, since in order for the sale to be valid, the customer must carry out the entire order process.

• After receiving an order, Jerusalem-land.com will commit a verification process to verify the customer’s details as well as verify with the credit card company. In case of non-compliance, the user will be notified about the matter by email to the email address he provided.
• Jerusalem-land.com reserves the right to choose the shipping company based on its sole considerations. The shipping fee is an additional cost and will be paid by the user only.
• Regarding the piece of land rental service, it will be clarified that at the end of the order, the user will receive a certificate to that effect, which includes his full name. In case no certificate is received, the user will contact Jerusalem-land.com via email: Jerusalem@gmail.com.
• Warranty – Jerusalem-land.com is not responsible for delays in the supply of products and/or services due to circumstances beyond its control, such as: faults and delays in the shipping company, communication failures, hostilities, strikes in the economy, supreme power events, etc.
• Jerusalem-land.com is not responsible for changes that may occur, such as a change of ownership of the land in whose territory the pieces of land that Jerusalem-land.com rented to the user for a limited period are located, land use change and any other change that will cause a change in the geographical location of the pieces of land within the State of Israel.
• The policy of return and exchange and cancellation of a transaction – Jerusalem-land.com respects the Consumer Protection Regulations (Cancellation of a Transaction), 2010&1981 the Consumer Protection Law. Cancellation of a transaction in accordance with the Consumer Protection (Cancellation of a Transaction) Regulations, 2010&1981 and the Consumer Protection Law.

With the original tax/receipt invoice, the product purchased within 14 days (when ordering online through the website) can be returned to the online store from the date of receipt in its original packaging and without defects and as long as it is not used and/or has no signs of use. In this case, it will be possible to get a refund or credit, and in any case, cancellation of a transaction will require the customer the following refunds:

• Shipping fees in case there were any;
• Cancellation fee of 5% of the transaction value or 100 NIS, the lowest among them.
• Jerusalem-land.com reserves itself the right to cancel in whole or in part the charges mentioned above.

• Regarding piece of land rental services, it will be clarified that in view of the fact that all the pieces of land offered in the online store by Jerusalem-land.com are the same size and their geographical location may change from time to time, therefore there is no point in switching.
• Moreover, with regard to the pieces of land, it should be emphasized that any payment for renting pieces of land constitutes a donation to one of the associations out of consideration by Jerusalem-land.com, which is made automatically, immediately after the payment is made. Therefore, it will not be possible to refund the money paid or cancel the transaction after the actual payment has been made.
• Order rejection – Jerusalem-land.com reserves itself the right to reject an order at its sole discretion and without prior notice even after the user has received an order confirmation from the website and received the offer/offers in a personal sale. In case of rejection of the order, the order will be canceled without charging the user and the details of the user will be destroyed. The user will be notified via email to the email address he provided.

The customer undertakes:

• Not to advertise for rent and not to rent to a third party the pieces of land he rented from Jerusalem-land.com;
• Not to advertise for sale or sell the party the pieces he has rented from Jerusalem-land.com.
• Not to build any type of construction, not to bury (humans, animals, etc., in full or in part), not to plant trees and vegetation, not to dig or make any changes – the customer himself and/or through someone on his behalf.
• In case the customer is interested in burying a tiny and symbolic object inside the piece of land he rented by Jerusalem-land.com, the customer undertakes not to bury an illegal object, such as a drug, poison, pollutant, stolen object, weapons, ammunition, etc.

5. Information on Personal and Non-Personal Identification Information:

5.1) The user is aware that the website on which the online store is located may collect personally identifiable information from the user in various ways, including, but not only, when the user is browsing the website, when placing an order, when operating/using the services and/or other resources provided by Jerusalem-land.com for the user. The user may be asked to give his personal details as usual: name, email address, postal address, landline and/or mobile phone number as well as credit card information and more (hereinafter: “Personal Information” and/or “Personal Identification Information”). However, the user can use the website anonymously without identification, except for placing an order and purchasing products and/or services in the online store, since this requires the provision of personal information necessary to complete the process of ordering products and/or services in the online store.

• 4.2) Understanding how products and/or services are consumed by the user to create a personal experience for the user;
• 4.3) Improving the performance of the website and/or the online store;
• 4.4) Sending information and updates to the user’s email regarding his order. When registering for the site, the user gives his consent to join the mailing list of Jerusalem-land.com and he will receive email updates, products, publications, new services, etc.
